Representatives of Facilities, Transporters or Vessels
The Emergency Release Notification Guidelines for Cuyahoga County Facilities, Transporters or Vessels explain the steps to follow to report an emergency release of a CERCLA Hazardous Substance or an EPCRA Extremely Hazardous Substance that exceeds a reportable amount.
You must notify some or all the agencies listed below within 30 minutes, if possible, each time you have a reportable release. than during an emergency.
Thresholds for Emergency Release Notification
The USEPA maintains a Consolidated List of Chemicals subject to the Emergency Planning and Community Right-To-Know Act (EPCRA) and Section 112(r) of the Clean Air Act. It is also called the "List of Lists." This list provides essential information about the threshold reporting amounts for Extremely Hazardous and CERCLA Hazardous Substances that must be reported in the event of an emergency release. Required Written Follow-up Notice
If the emergency release of a CERCLA Hazardous Substance or an EPCRA Extremely Hazardous Substance exceeds a reportable amount (see above USEPA List of Lists) you must complete and submit a written follow-up notice that provides additional information about the incident. This requirement is outlined in the Emergency Release Notification Guidelines for Cuyahoga County.

Penalty for Failing to Provide Emergency Notification
Ohio Revised Code Section 3750.06 provides both civil and criminal penalties for failure to follow the above guidelines subsequent to a reportable emergency release. The LEPC has enforced these requirements when necessary.

has reached settlements with the Commercial Forgings (2003 - $5,900), the Acme
Construction Company (2002 - $7,000),
the Ashland Chemical Company (2001 -
$3,437.50), Ohio Aluminum Industries,
Inc. (2001 - $2,310), Ohio Pool
Equipment Supply Company (2001 - $4,000)
and SPS Technologies (2001 - $9500)
following spills of Hazardous or
Extremely Hazardous Substances.
General Public
Members of the general public can report an emergency release by calling 9-1-1.
Operators at CECOMS (216) 771-1365 and the Ohio
SERC (800) 282-9378 will also record emergency release information from those wishing to make these contacts.
